Firstly you must be married, and either party must at the date of the filing of the divorce application:
- be an Australian citizen; or
- an Australian “ordinary resident”; or
- Domiciled in Australia.
Domicile in Family Law context means the country where a person lives with the ‘intention to make his or her home indefinitely’. Domicile Act 1982 (ACT) s10.
